When you place an order over the Internet, email, phone, or any other means, you are entering into a binding contract with MetropolitanScooters.net and/or MetropolitanScooters.com

By accessing or using this Site, you agree to these terms of use, policies, conditions and all applicable laws.  If you do not agree to these terms you may not use this Site.  Your continued use of this web site or purchasing via our website constitutes acceptance of the terms and conditions, shipping polices, warranty policy, and all other policies stated at the time of your use. You are responsible for regularly reviewing these terms and conditions.

MODIFICATION OF THESE TERMS OF USE 
 

MetropolitanScooters.net and/or MetropolitanScooters.com reserves the right to change the terms, conditions, and notices under which the MetropolitanScooters.net and/or MetropolitanScooters.com Sites are offered, including but not limited to the charges associated with the use of the Metropolitan Scooters Web Sites.    

Price Guarantee
MetropolitanScooters.net and/or MetropolitanScooters.com will honor any sales quote within 14 days of the quote.  All quotes must be submitted in written or email form to be accepted.  We work to keep our prices the lowest in the industry.  Sometimes we are able to get special savings on some units. We pass those savings onto our customers for those units which may result in a price difference from your purchase price.  If you purchase a unit and the price for a similar unit is different, we are unable to issue a refund of the difference.
 

Layaway Policy
We offer layaway options on most units.  The layaway plan terms are a percentage of the unit price as a down payment and the remainder of the price due within 30 days thereafter.  Each unit offered for Layaway will have it's own terms noted for approval by the purchaser prior to purchase.  Purchaser will be required to accept those terms to place their purchase on Layaway.  Please note that all layaways are non-transferrable and non-refundable.  If you miss a payment on the unit, we will have no choice but to cancel the layaway and place the unit back up for sale.  The terms of the Layaway policy are non-negotiable.

Warranty Policy
Our warranties differ in items covered and the length and duration of any particular warranty.  All of our vehicle warranties DO NOT COVER labor charges.  Labor charges and fees are the responsibility of the purchaser.  Metropolitan Scooters will not cover labor fees and/or charges.  Metropolitan Scooters' warranties only cover parts replacement and only for the time indicated in the warranty stated for a particular vehicle. 

Inaccuracies, Product Variations, and Changes
MetropolitanScooters.net and/or MetropolitanScooters.com makes every attempt to accurately list all product information on our website and auction listings.  It is possible, however, that unforeseen typographical errors, picture errors, or inaccurate information may occur.  We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice, including information pertaining to orders that have already been placed.  We apologize for any inconvenience caused by any such errors.

 

MetropolitanScooters.net and/or MetropolitanScooters.com carries a wide range of products from various manufacturers, and each shipment may vary slightly.  Actual models shipped may have different manufacturer name, decals, stickers, or model numbers from the website, auction listing, in-store display, or salesperson description; however, the product model number and specifications will be similar or the same.

MetropolitanScooters.net and/or MetropolitanScooters.com reserves the right to upgrade any order if the product ordered is out of stock at the time of shipping.  The term "upgrade" means that our supplier will ship a more expensive model, with the same or similar features, at their discretion.  If the customer chooses to keep the upgraded model there will be no additional charge.  If the customer does not want the upgraded model, MetropolitanScooters.net and/or MetropolitanScooters.com must be contacted immediately at the time of delivery for a refund.  Once the box is opened or the unit is taken out of the crate, the unit cannot be returned.

If you receive an incorrect MSO, it is your responsibility to return the incorrect title prior to the replacement being shipped.  We strive to make our MSO process as error-free as possible, but there are times complications do arise.  We apologize for any issues this might cause.

MetropolitanScooters.net and/or MetropolitanScooters.com MAKES REASONABLE EFFORTS TO PLACE ACCURATE INFORMATION ON THIS WEB SITE. Color of Units
When an order is placed, we require the customer to provide two color choices.  We are able to ship out most units with the first color choice; however, due to fluctuations in our inventory, occasionally a color may not be in stock at the time of shipment.  If the customer's first color choice is unavailable, we will ship the unit with the second color choice.  The order is considered to be correct when filled with either the first color choice or second color choice.  If a customer chooses only one color for a unit when placing an order, our system will automatically choose a second color based on our current stock.  Color choices are not guaranteed.  MetropolitanScooters.net and/or MetropolitanScooters.com reserves the right to ship another color if none of your color choices are available at the time of order processing.

Assembly
Some assembly is required on most units sold by MetropolitanScooters.net and/or MetropolitanScooters.com.  Each unit is unique and has different assembly requirements.  Common assemblies include: mounting wheels (nuts and bolts, tires already mounted on wheel), handlebar (nuts and bolts), electrical connection (simple plug-in), battery hook-up (nuts and screws) and mirrors (screws).  Mechanical assemblies such as motors or carburetors are not required.  Our units can usually be assembled within 30 minutes to 3 hours, depending on the type of unit.  Although assembly of our units may be simple, we highly recommend you have a certified automotive or motorcycle technician complete your assembly to assure that your vehicle is properly assembled and safe to ride.  Certain units may not include detailed assembly instructions or manuals.

Cancellation Policy
MetropolitanScooters.net and/or MetropolitanScooters.com processes all orders immediately and sent to our warehouse for shipping.  Once your order has been processed and you wish to cancel, you will be charged a cancellation fee of 30% of the cost of your order.  If your order has been processed and shipped and you wish to cancel, you will be charged a cancellation fee of 30% of the cost of your order, plus all shipping costs incurred for MetropolitanScooters.net and/or MetropolitanScooters.com to ship the unit to you (even for a unit offered with free shipping), and all shipping costs to return the unit to MetropolitanScooters.net and/or MetropolitanScooters.com.  

All cancellations must be sent in writing, via e-mail or fax.  Please contact your salesperson for the correct e-mail address or fax number for submitting cancellation requests.  Orders cannot be canceled over the phone, but you may contact your salesperson by phone to confirm that your written cancellation request has been received.

Orders may not be canceled or refused due to extended shipping times.  Orders may only be canceled if the order exceed 30 business days for transit. Orders cannot be canceled because of a delay in the processing and shipping of the MCO/MSO unless the shipping of the MCO/MSO exceeds 45 days from the date the vehicle's VIN being provided to Metropolitan Scooters by the purchaser. Purchaser must be able to provide proof of the original date the VIN was sent.

Condition of vehicles
Chinese scooters, ATVs, dirt bikes, go karts, etc sometimes do not have a flawless fit and finish.  You may find minor scratches, scuffs, pinholes in the paint and various others minor flaws in your Chinese vehicle upon inspection.  This is common for these vehicles and as such are not covered under warranty.  When receiving your shipment carefully inspect your vehicle BEFORE the delivery driver leaves.  To be eligible for warranty replacement or repair the damages must be noted on the delivery driver's manifest/receipt.  Delivery drivers know they have to allow you time to inspect your delivery so don't let them tell you anything different.  Also, during shipping and handling items like electrical connections, gas lines, vacuum lines etc can become disconnected, crimped or pinched.  It is the responsibility of the purchaser to reconnect, reroute or perform whatever task is necessary to eliminate the problem.  It is not the responsibility of Metropolitan Scooters to insure such problems do not arise as it is out of our control once it leaves our facility.  Do not refuse a delivery without contacting Metropolitan Scooters first.  We will not honor any refused shipment without prior approval from Metropolitan Scooters.  If the shipment is refused without approval the purchaser is liable for whatever shipping charges Metropolitan Scooters incurs as a result of the refused shipment.

Shipping
All shipping costs are nonrefundable.  Any and all damages are solely between the shipping company and receiver.   It is imperative you thoroughly check out your vehicle before allowing the delivery driver to leave and before you sign his manifest.  If damages are found immediately report them to the shipping company and note the damages in full on the delivery  driver's manifest.  The shipping company is responsible for any damages and you must file a claim with them for recovery.  Metropolitan Scooters is not responsible for merchandise once it leaves our facility. 
Do not refuse a delivery without contacting Metropolitan Scooters first.  We will not honor any refused shipment without prior approval from Metropolitan Scooters.  If the shipment is refused without approval the purchaser is liable for whatever shipping charges Metropolitan Scooters incurs as a result of the refused shipment.

Reservation of Rights
Any rights not expressly granted herein are reserved.
